MOTION RIDE TERMS AND CONDITIONS

- INTRODUCTION
Welcome to Motion Ride and its associated platforms, including Motion Pro, Motion Check, and related services (collectively, the “Apps” or “Services”), operated by Motion Ride PLC. (“Company,” “We,” “Our,” or “Us”). These Terms and Conditions (“Terms”) govern your access to and use of our mobile application, website www.motionride.co, and all related services, including any future updates or features. By downloading, installing, registering, accessing, or using the App, you acknowledge that you have read, understood, and agree to be bound by these Terms, as well as our Privacy Policy. If you do not agree with any part of these Terms, you must not use the App or any Services. We recommend reviewing these Terms periodically, as they may be updated in accordance with Section 16.
- DEFINITIONS
For clarity and consistency, the following terms are defined as follows:
- Company: Motion Technologies Ltd., a company registered in Cameroon, operating the Apps and Services.
- User: Any individual or entity accessing or using the App, including customers, drivers, idle drivers, mechanics, insurance providers, and partners.
- Driver: An individual registered to provide transportation services using their own vehicle through the App.
- Idle Driver: An individual registered to provide driving services without owning a vehicle, available for hire by Users.
- Mechanic: An individual or entity providing vehicle maintenance, repair, or emergency breakdown services through the App.
- Insurance Partner: A licensed insurance provider offering policies or services through the App.
- Partner: Authorized third parties, such as country administrators or agents, responsible for managing drivers, mechanics, or insurance providers within the App.
- Ride: A transportation service (e.g., car, bike, tricycle, or van) requested and booked via the App.
- Services: All functionalities provided by the App, including ride-hailing, driver hiring, mechanical services, insurance payments, Motion Pro tools, Motion Check diagnostics, live tracking, and maintenance support.
- Content: All text, images, logos, software, code, and other materials available on the App.
- Transaction: Any financial exchange facilitated through the App, including payments for rides, services, or insurance.
- ELIGIBILITY
To use the Apps and Services, you must meet the following criteria:
- Be at least 18 years of age or the legal age of majority in your jurisdiction.
- For Drivers: Hold a valid driver’s license recognized by the authorities in your operating country and provide proof of vehicle registration and insurance (if applicable).
- For Mechanics: Provide proof of professional certification or business registration.
- For Insurance Partners: Be a licensed insurance provider with valid business documentation.
- Provide true, accurate, and up-to-date information during registration, subject to verification (e.g., ID checks, license validation).
- Agree to comply with all applicable local, national, and international laws.
Failure to meet these criteria or providing false information may result in account suspension or termination. Motion reserves the right to request additional documentation to verify eligibility at any time.
- Motion Shop – Spare Parts & E-Commerce
Explanation: This section details the operations of Motion Shop, the platform’s e-commerce component for purchasing vehicle-related products. It covers product listings, payments, delivery, warranties, returns, and liability, ensuring transparency in how the marketplace functions. The goal is to protect both the company and users by setting clear expectations for transactions.
Key Points:
- Product Listings: Products come from verified suppliers, ensuring quality and reliability. This reduces the risk of counterfeit or substandard parts.
- Payments: Transactions must be completed through approved channels (likely in-App payment systems), ensuring secure and trackable payments.
- Delivery: Timelines vary based on location and logistics, which users should consider when planning purchases.
- Warranties: Products carry manufacturer or supplier warranties, but Motion itself does not guarantee third-party products, limiting its liability.
- Returns & Refunds: Strict conditions (unused products, original packaging, 7-day window) protect the company while offering users a fair return policy.
- Liability: Motion disclaims responsibility for damages caused by improper use or installation, shifting responsibility to users or suppliers.
Practical Implication: Users must carefully follow Motion Shop’s policies to ensure successful transactions. For example, attempting to return a used part after 7 days would likely be rejected. Additionally, users should verify product compatibility before purchase, as Motion is not liable for misuse.
- Motion Rentals – Car Rental Services
Explanation: This section governs the use of Motion Rentals, which provides short- and long-term vehicle rentals. It outlines eligibility criteria, rental periods, security deposits, insurance, liability, and prohibited uses, ensuring renters understand their responsibilities and the company’s protections.
Key Points:
- Eligibility: Renters must be at least 21 and hold a valid driver’s license, with additional documentation (e.g., ID or passport) required in some cases. This ensures only qualified individuals rent vehicles.
- Rental Period: Flexible rental options (daily, weekly, monthly) cater to diverse needs, but late returns incur extra charges, encouraging timely returns.
- Security Deposit: A refundable deposit protects Motion against damages or breaches, with deductions for issues like traffic fines or vehicle damage.
- Insurance: Basic insurance is included, but renters may need to cover deductibles or opt for additional coverage, clarifying financial responsibilities.
- Damages & Liability: Renters are accountable for damages unless covered by insurance, and Motion can charge repair costs or deduct from the deposit.
- Prohibited Use: Restrictions on illegal activities, racing, subleasing, smoking, or transporting hazardous materials protect the vehicles and ensure compliance with laws.
- Breakdowns: Renters must report issues immediately, and Motion provides roadside assistance or replacements where feasible, ensuring user safety and service reliability.
Practical Implication: Renters must comply with these rules to avoid penalties. For example, using a rental vehicle for racing could void insurance coverage and lead to liability for damages. Renters should also plan for potential deposit deductions and ensure they understand insurance terms before renting.
- SERVICES OFFERED
Motion Technologies Ltd. operates a multi-service platform designed to connect Users with transportation, maintenance, and insurance solutions. The Services include, but are not limited to:
- Ride-Hailing: Book transportation services (cars, bikes, tricycles, or vans) through the App, with real-time matching based on location and availability.
- Idle Driver Services: Hire qualified drivers who do not own vehicles for temporary or long-term driving needs.
- Mechanical Services: Access vetted mechanics for vehicle repairs, routine servicing, or emergency roadside assistance.
- Insurance Services: Purchase, renew, or manage vehicle insurance policies directly from approved Insurance Partners.
- Motion Pro: Advanced tools for drivers and mechanics, including analytics, scheduling, and performance tracking.
- Motion Check: Diagnostic services that analyze vehicle dashboard signals to identify faults and recommend repairs.
- Live Tracking: Real-time GPS tracking for rides and services, ensuring safety and accountability.
- Maintenance Support: Automated reminders for preventive maintenance and service bookings with trusted mechanics.
Services may vary by region and are subject to change as new features are introduced. Users acknowledge that not all Services may be available in their location or at all times.
- USER ACCOUNTS
To access the Services, you must create an account by providing accurate personal and/or business information (e.g., name, email, phone number). The following applies:
- Account Creation: Accounts are created via the App or website, requiring email or phone verification. You may be required to provide additional documentation (e.g., ID, licenses) for specific roles (e.g., Driver, Mechanic).
- Account Security: You are solely responsible for maintaining the confidentiality of your username, password, and other login details. Notify us immediately of any unauthorized access or suspected breach.
- Account Activity: Motion may suspend or terminate accounts that are:
- Fraudulent or providing false information.
- Inactive for 12 consecutive months.
- In violation of these Terms or applicable laws.
- Account Recovery: If your account is compromised, follow the recovery process outlined in the App’s support section or contact us as per Section 17.
Users may only maintain one active account per role (e.g., one Driver account, one Customer account). Creating multiple accounts to exploit promotions or bypass restrictions is prohibited.
- DRIVER, MECHANIC, AND PARTNER RESPONSIBILITIES
Service providers on the Motion platform must adhere to the following:
- Drivers:
- Maintain a valid driver’s license, vehicle registration, and insurance (where applicable).
- Ensure vehicles are roadworthy, regularly inspected, and compliant with local regulations.
- Provide safe, courteous, and professional transportation services.
- Idle Drivers:
- Demonstrate driving competence through tests or certifications as required by Motion or local authorities.
- Maintain good conduct and professionalism when hired by Users.
- Mechanics:
- Hold valid certifications or licenses for vehicle repair and maintenance.
- Perform services with due care, skill, and professionalism, using appropriate tools and parts.
- Provide accurate estimates and timelines for services.
- Insurance Partners:
- Offer transparent, accurate policy information and comply with all applicable insurance regulations.
- Process claims promptly and fairly in accordance with policy terms and local laws.
- Partners:
- Manage drivers, mechanics, and insurance providers in their designated regions.
- Approve or reject accounts based on compliance with Motion’s standards.
- Ensure all managed parties adhere to these Terms and local regulations.
Failure to meet these responsibilities may result in suspension, termination, or legal action, as determined by Motion.
- BOOKINGS, PAYMENTS & COMMISSIONS
All financial transactions on the App are subject to the following:
- Bookings: Rides, driver hires, mechanical services, or insurance purchases must be booked through the App’s interface. Users agree to provide accurate details (e.g., pick-up location, service type).
- Payments: Payments must be made via the App’s secure payment system, supporting methods like credit/debit cards, mobile money, or other approved options. Cash transactions outside the App are not permitted and are at the User’s risk.
- Commissions: Motion charges a commission on each completed Transaction, which may vary based on:
- Service type (e.g., ride-hailing, mechanical services).
- Transaction value (e.g., a percentage of the ride fare or service cost).
- Market conditions (e.g., demand surges, promotional periods).
- Pricing: Prices are dynamic and may depend on distance, time of day, demand, or additional factors (e.g., taxes, surcharges). Final prices are displayed in the App before confirming a Transaction.
- Failed Payments: Users are responsible for ensuring sufficient funds or valid payment methods. Failed payments may result in service cancellation or account restrictions.
- Disputes: Payment disputes must be reported within 7 days of the Transaction via the App’s support system.
Motion is not liable for any losses, disputes, or damages arising from unauthorized cash transactions or payment errors.
- CANCELLATIONS & REFUNDS
The following governs cancellations and refunds:
- Cancellations:
- Customers may cancel a Ride or service before the Driver, Mechanic, or Partner confirms acceptance (e.g., within 5 minutes of booking for Rides).
- Drivers or Mechanics may cancel with valid reasons (e.g., safety concerns, vehicle issues), subject to Motion’s review.
- Late cancellations by Users may incur a fee, as displayed in the App.
- Refunds:
- Eligible refunds (e.g., for unfulfilled services or cancellations within policy) will be processed via the original payment method within 3–14 business days.
- Partial refunds may apply if a service is partially completed or canceled late.
- Motion reserves the right to refuse refunds for:
- Misuse of the App (e.g., fraudulent bookings).
- Violations of these Terms.
- Cancellations outside the allowed timeframe.
- Process: Refund requests must be submitted via the App’s support section, including relevant details (e.g., Transaction ID, reason for request).
Users acknowledge that refund decisions are at Motion’s sole discretion, subject to these Terms and applicable laws.
- SERVICE AVAILABILITY
Motion strives to provide reliable Services but does not guarantee uninterrupted, timely, or error-free access due to factors such as:
- Network or internet connectivity issues.
- Geographic restrictions or limited-service coverage.
- Scheduled maintenance or unforeseen disruptions (e.g., server outages, natural disasters).
- Operational capacity (e.g., availability of Drivers or Mechanics).
Motion may prioritize Services in certain regions based on demand, infrastructure, or partnerships. Users acknowledge that Services may not be available in all locations or at all times.
- LIABILITY & DISCLAIMERS
Motion Technologies Ltd. operates as a technology platform connecting Users with independent service providers (Drivers, Mechanics, Insurance Partners, etc.). The following applies:
- Limited Liability: Motion is not liable for:
- Accidents, injuries, damages, or losses during Rides or services.
- Delays, cancellations, or disputes caused by service providers or Users.
- Inaccuracies in insurance policies or claim denials by Insurance Partners.
- Losses from unauthorized transactions or User errors.
- Third-Party Risks: Users assume all risks associated with engaging third-party service providers through the App.
- Disclaimers: To the fullest extent permitted by law, Motion disclaims all warranties (express or implied), including warranties of merchantability, fitness for a particular purpose, or non-infringement. Motion does not guarantee the quality, safety, or legality of services provided by third parties.
Users agree to indemnify and hold Motion harmless from claims, damages, or losses arising from their use of the App or Services.
- PRIVACY & DATA PROTECTION
Motion collects, processes, and stores personal data in accordance with our Privacy Policy, available at [Insert Privacy Policy URL]. By using the App, you consent to:
- Data Collection: Collection of data such as name, contact details, location, payment information, and vehicle diagnostics (for Motion Check).
- Data Use: Sharing necessary data with Drivers, Mechanics, Insurance Partners, or Partners to facilitate Services (e.g., sharing location for ride pickups).
- Data Security: Use of encryption and other industry-standard measures to protect sensitive data.
- User Rights: Options to access, correct, or request deletion of your data, subject to legal requirements.
Motion will not sell or misuse your data without consent and complies with applicable data protection laws (e.g., [Insert relevant laws, e.g., GDPR, Cameroon Data Protection Act]). For details, refer to our Privacy Policy.
- INTELLECTUAL PROPERTY
All Content on the App, including trademarks, logos, software, designs, text, images, and code, is the exclusive property of Motion Technologies Ltd. or its licensors. Users agree:
- Not to reproduce, distribute, modify, or reverse-engineer any Content without written permission from Motion.
- To use Content only for personal, non-commercial purposes (e.g., sharing a ride receipt).
- That unauthorized use may result in legal action, including claims for damages or injunctive relief.
Motion grants Users a limited, non-exclusive, revocable license to access and use the App for its intended purpose, subject to these Terms.
- PROHIBITED ACTIVITIES
Users must not engage in activities that harm the App, its users, or its operations, including but not limited to:
- Using the App for illegal purposes or violating local, national, or international laws.
- Providing false, misleading, or fraudulent information during registration or Transactions.
- Harassing, threatening, or abusing Drivers, Mechanics, Partners, or other Users.
- Attempting to hack, disrupt, or exploit the App’s systems or security measures.
- Creating multiple accounts to bypass restrictions or exploit promotions.
- Posting or sharing harmful, offensive, or defamatory content.
Violations may result in account suspension, termination, or legal action, at Motion’s discretion.
- TERMINATION
Motion may suspend or terminate your account for:
- Violating these Terms or applicable laws.
- Engaging in fraudulent or harmful activities.
- Failing to meet eligibility or responsibility requirements.
- Inactivity for 12 consecutive months.
Users may deactivate their accounts by contacting support as per Section 17. Upon termination:
- Outstanding obligations (e.g., unpaid fees, dispute resolutions) remain enforceable.
- Motion may retain certain data as required by law or for operational purposes (e.g., transaction records).
- Users may appeal terminations within 30 days by contacting support, subject to Motion’s review.
- GOVERNING LAW & DISPUTE RESOLUTION
These Terms are governed by the laws of [Insert Country, e.g., Cameroon]. Any disputes arising from or related to these Terms or the Services shall be resolved as follows:
- Negotiation: Parties will attempt to resolve disputes amicably within 30 days of notification.
- Mediation: If unresolved, disputes will proceed to mediation within 60 days, facilitated by a mutually agreed mediator.
- Arbitration or Courts: If mediation fails, disputes will be resolved through binding arbitration or competent courts in [Insert City, e.g., Yaoundé], as determined by Motion.
Users bear their own legal costs unless otherwise agreed. This clause does not limit your statutory rights under applicable laws.
- UPDATES TO TERMS
Motion reserves the right to modify or update these Terms at any time to reflect changes in laws, business practices, or Services. Updates will be communicated via:
- Email or in-app notifications to registered Users.
- Posting on the App or website www.motionride.co,
Changes take effect 30 days after notification. Continued use of the App or Services after this period constitutes acceptance of the updated Terms. If you disagree with the changes, you may deactivate your account as per Section 14.
